On 20 January 2009 the new rules of classification and labelling came into force.
The GHS labelling system can now be used
From now on the classification regulation, which changes the previous classification system to a system based on the global GHS labelling system, applies.
It is still voluntary to use the new rules
To ease the transition from the old system to the new an interim arrangement has been made. This means that for now it is voluntary to classify and label according to the new rules. In connection with substances this applies until 1 December 2010 and for mixtures until 1 June 2015 (see the item about deadlines further below).
What are the changes?
The largest changes are that gradually new hazard symbols must be used on labels. The symbols have a new frame and colour. Instead of the known square with orange background, the new symbols have an upright red frame with a white background. The symbol itself will in most cases not change substantially.
Classification, packaging and labelling of chemical substances and mixtures
The new classification regulation is called CLP (Classification, Labelling and Packaging).
According to the CLP regulation substances must be classified, packed and labelled in accordance with this regulation not later than 1 December 2010 and mixtures as of 1 June 2015. However, already when the regulation comes into force it will be legal to classify, pack and label substances as well as mixtures in accordance with the regulation.
Substances and mixtures already on the market on 1 December 2010 (substances)/1 June 2015 (mixtures) must not later than 1 December 2012 (substances)/1 June 2017 (mixtures) be re-labelled and repacked in accordance with the CLP regulation.
The harmonization of classification, labelling and packaging of chemical substances and mixtures in accordance with the CLP regulation is binding in the member countries. The criteria for classification and labelling as well as the requirements for packaging must therefore be followed in connection with self classification as well as when a substance is entered in the list of dangerous substances.
