Do you have a duty to inform you customers?
The first list of substances which are of concern in connection with REACH has now been issued.
Approval of substances from the candidate list
This concerns substances requiring authorisation - which means an approval to be able to work with them. These substances are also called SVHC substances (Substances of Very High Concern) or appendix XIV substances and the list is called "the candidate list".
You must take a stand on the candidate list
New substances are continously added to the candidate list.

Manufactures and importers of chemicals or articles
As manufacturer or importer of chemicals or articles you must know if your products contain more than 0.1% of a substance in the list.
Information duty!
If your products contain one or more of the substances of concern you have a duty to inform you customers according to REACH.
Sale of substances or chemical mixtures - must you inform your customers?
If you sell one of the substances in the list or if you sell a chemical mixture containing a substance in the list this must be evident in the safety data sheet you hand over to your customers. This applies as of 28 October 2008.
Sale of articles - must you inform your customers?
If you sell articles containing more than 0.1% of a substance on the list you must inform your customers about the content of the substance and how to use the article safely. An easy way to pass on this piece of information is to supply a safety data sheet. This applies as of 28 October 2008.
Import of articles - must you inform your customers?
If you import articles from outside the EU containing more than 0.1% of a substance in the list and you import more than 1 ton/year totally of the substance you must inform the chemical agency in Helsinki as of 1 December 2011.
Substances of concern must thus neither be pre-registered nor registered.
